LIABILITY WAIVER, ASSUMPTION OF RISK, AND RELEASE AGREEMENT

Location: 4 Murray Hill Drive, Mount Morris, NY 14510
Dates: October 17, 18, 24, 25, 2025
By signing this document, you waive and release certain legal rights, including the right to sue for injuries, damages, or losses arising out of participation in this event.
Assumption of Risk: The undersigned (“Participant”) understands and acknowledges that participation in the Haunted House: Survive the Sanitorium event (the “Event”) involves inherent and voluntary risks, including but not limited to: physical injuries (e.g., slips, trips, falls, collisions, cuts, bruises)psychological distress (e.g., fear, anxiety, panic, emotional shock), exposure to potentially hazardous conditions (e.g., low lighting, strobe lights, loud noises, fog, special effects, sudden movements, uneven surfaces, stairs, confined spaces, and simulated violence), Contact with other participants, volunteers, props, and environmental hazards. These risks cannot be eliminated without altering the essential nature of the Event.
By signing below, the Participant voluntarily assumes all such risks, known and unknown, including those that may result in injury, illness, permanent disability, or death.
Release and Waiver of Liability: In consideration of being allowed to participate, the Participant, on behalf of themselves, their heirs, executors, administrators, assigns, and representatives, fully and forever releases, waives, and discharges: Genesee Valley Council on the Arts (GVCA), Livingston County, C & F Transportation, and all of their officers, directors, employees, agents, contractors, sponsors, volunteers, successors, and affiliates (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, or causes of action arising out of or related to participation in the Event, whether caused by negligence, gross negligence, premises conditions, acts of third parties, or otherwise, including but not limited to claims for: personal injury, emotional distress, property damage or loss, illness or death. This waiver applies to the fullest extent permitted by law.
Indemnification: The Participant agrees to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: The Participant’s actions or omissions during the Event, violation of any rules, laws, or instructions, claims brought by third parties resulting from the Participant’s conduct. This obligation survives the conclusion of the Event.
Medical Fitness and Treatment: The Participant affirms that they are physically and mentally capable of participating in the Event and have no medical conditions or impairments that would make participation unsafe.
In the event of an accident, illness, or emergency, the Participant: authorizes the Event organizers, volunteers, or emergency personnel to provide or obtain medical treatment as deemed necessary and accepts full financial responsibility for all medical expenses incurred, whether covered by insurance or not. The Released Parties do not assume responsibility for any medical care provided.
Photography, Video, and Media Release: The Participant understands that photographs, video recordings, and other media (“Media”) may be taken during the Event. By signing below, the Participant: grants the Released Parties an irrevocable, worldwide, royalty-free license to use, reproduce, publish, broadcast, and distribute such Media for promotional, marketing, educational, and other lawful purposes, and waives any right to inspect or approve the Media or receive compensation.
Compliance with Rules and Removal: The Participant agrees to follow all Event rules, safety instructions, and directions provided by staff, volunteers, or security. The Event organizers reserve the right to remove any participant for unsafe, disruptive, or unlawful behavior without refund or recourse.
Age and Capacity to Consent: Participants must be at least 18 years of age to sign this waiver. If under 18, a parent or legal guardian must sign on behalf of the minor Participant and assumes full responsibility for the minor’s participation.
Governing Law and Venue: This Agreement shall be governed by and construed under the laws of the State of New York.
The Participant agrees that any disputes arising under this Agreement shall be brought exclusively in the state or federal courts located in Livingston County, New York.
Severability: If any portion of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Acknowledgment and Acceptance: By signing below, the Participant confirms they have read and understood this document in its entirety, acknowledges they are voluntarily giving up substantial legal rights, and agrees to be bound by the terms of this Agreement.
